These Terms of Service (“Terms”) govern your access to and use of the website gotechmedia.site (the “Site”) and the services provided by GoTech Media (“GoTech Media,” “we,” “us,” or “our”), including website development, mobile app development, UI/UX & branding, SEO & digital marketing, and paid advertising services (collectively, the “Services”).
By accessing our Site, submitting an inquiry, or engaging us for Services, you (“Client,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, please do not use our Site or Services.
1. Services
GoTech Media provides digital agency services including but not limited to:
- Website development
- Mobile app development (Android/iOS)
- UI/UX design & branding
- SEO & digital marketing
- Paid advertising (Meta Ads, Google Ads)
Specific scope, deliverables, timelines, and pricing for any engagement will be defined in a separate written proposal, quotation, statement of work (“SOW”), or service agreement (“Agreement”), which forms part of these Terms. In case of conflict, the specific Agreement will prevail over these general Terms.
2. Proposals, Quotations & Engagement
- Quotations and proposals are valid for the period stated therein (or 30 days, if unspecified) and are subject to change thereafter.
- An engagement is confirmed only upon written acceptance of a proposal/SOW and, where applicable, payment of the agreed advance.
- Any changes to project scope after confirmation will be treated as a change request and may affect timelines and pricing (see Section 5).
3. Client Responsibilities
To enable timely delivery, the Client agrees to:
- Provide accurate project requirements, content, brand assets, and access/credentials in a timely manner
- Designate a point of contact for approvals and feedback
- Respond to review requests within agreed timeframes
- Ensure they hold necessary rights/licenses for any content, images, trademarks, or third-party material supplied to us
- Make payments as per the agreed schedule
Delays caused by the Client (late feedback, missing assets, delayed approvals) may extend project timelines proportionately and are not considered a breach by GoTech Media.
4. Payment Terms
- Pricing is as specified in the applicable proposal/Agreement, exclusive of applicable taxes (GST) unless stated otherwise.
- Standard payment structure (unless otherwise agreed): an upfront advance to commence work, with balance payments tied to milestones or project completion.
- Invoices are payable within the timeframe specified on the invoice (typically 7–15 days).
- Late payments may attract interest and/or suspension of work/deliverables until dues are cleared.
- Recurring services (maintenance, SEO, ad management, hosting, etc.) are billed on a monthly/periodic basis as agreed and continue until terminated per Section 9.
- Third-party costs (domain, hosting, ad spend, licenses, plugins, stock assets, app store fees) are billed separately or passed through, as agreed in the SOW, and are the Client’s responsibility.
5. Revisions & Change Requests
- Each engagement includes a defined number of revision rounds, as specified in the Agreement.
- Requests beyond the agreed scope or revision limit, or changes to core requirements after work has begun, will be quoted and billed separately as a change request.
6. Intellectual Property
- Upon full and final payment, ownership of final deliverables created specifically for the Client (custom code, designs, content) transfers to the Client, except as noted below.
- GoTech Media retains ownership of pre-existing tools, frameworks, proprietary code libraries, methodologies, and reusable components used to deliver the Services, and grants the Client a license to use these as part of the delivered project.
- Third-party assets (licensed themes, plugins, stock photos, fonts, SaaS tools) remain subject to their respective third-party licenses and are not owned by either party.
- GoTech Media reserves the right to showcase completed work (screenshots, case studies, links) in its portfolio and marketing materials, unless the Client requests confidentiality in writing.
- Until full payment is received, all deliverables remain the property of GoTech Media.
